In case No. ՎԴ/7806/05/21, on 13.07.21, a lawsuit was filed against Ashtarak community of Aragatsotn marz, invalidating the decision No. 302-Ա on granting construction permit made on 26.05.2021 and construction permit No. 57 of 26.05.2021 about recognition requirements. The claim was based on the alleged violation of the Claimant's rights, on the basis of blocking the road leading to the plot of land allocated to him with the right of development. In particular, the only road leading to the plot provided to the plaintiff by the Community, according to the submitted claim, was closed as a result of construction carried out by a third party.

The senior lawyer of our company, attorney Gohar Avagyan, under the coordination of director-shareholder in domestic affairs, attorney Norayr Balayan, assuming the protection of the interests of the third party and being involved in the case as a representative of the third party, submitted written objections and evidence that substantiated the favorable administrative act against the third party. the legality and justification of the establishment and actions of the third party.

In the judicial act, the Court makes a detailed reference to the grounds for contesting the administrative act, the legal interest of the persons presenting a legal claim for its invalidity, as well as the correlation of the dates of origin of the rights granted by the contested administrative act with the requested obligation.

As a result, the court completely rejected the claim, leaving the administrative act in legal force.
