"ELL Partnership" Law Firm Continues Expanding the Horizons of Freedom by Achieving Success in a New Field.
We are pleased to announce that on May 10th, this year, our firm presented the first case of international mediation at the Armenian Center for Arbitration and Mediation. Our Senior Lawyer and Advocate Gohar Avagyan represented one of the parties in a family dispute regarding the determination of a child’s place of residence.
As a result, the parties’ve reached an out-of-court settlement. The mediation process was conducted by mediator Hayk Barseghyan.
One of the key features of this mediation process was the fact that it was conducted in both Armenian and English via an online platform to ensure the participation of a non-resident party in the mediation process.
Following the conclusion of the settlement agreement, an application for the ratification of the out-of-court settlement agreement signed with the participation of a certified mediator was submitted to the court within the framework of the "Proceedings for the Ratification of the Settlement Agreement Signed with the Participation of a Certified Mediator”, which was ratified by the First Instance Court of General Jurisdiction of Yerevan on August 23rd, this year.
Such cases are particularly significant in the context of shaping judicial practice, considering the development of the mediation sector in Armenia and the unique aspects of online mediation. This process allowed for the resolution of the dispute between the parties without resorting to litigation, which is especially important in family cases, given the legal and moral aspects of determining a child’s place of residence and the importance of maintaining amicable relations between the parties in the best interest of the child.
Another success has been recorded, and we congratulate both the parties to the settlement and, of course, our firm on this achievement.
