Significant Victory in the Field of Intellectual Property Rights

“ELL Partnership” Law Firm has recorded another success in the field of intellectual property rights protection.
The case concerned the registration of the trademark “Anapak” by our client company, which was challenged by another economic operator acting under a different trademark in the same industry.
The opposing party claimed that “Anapak” is a geographical name (referring to Mount Anapak) and that the name was used to indicate that water was being sourced from that specific location.
This claim was found unacceptable not only by our firm but also by the Intellectual Property Office of the Republic of Armenia, which was the respondent in the case. Following an effective defense strategy and thorough submission of evidence, including legal and factual justifications, the Administrative Court of the Republic of Armenia rightfully rejected the claim, leaving the registration of the “Anapak” trademark in force.
The Court fully accepted our arguments that our client’s trademark does not contain false or misleading information and lacks any elements that might deceive consumers regarding the geographical origin, quality, nature, or producer of the goods or services. Furthermore, it was proven that the trademark had never been previously registered as a trademark, geographical indication, or designation of origin, nor had it been put into genuine use, which would otherwise have rendered it ineligible for registration.
Ensuring fair economic competition requires, among other factors, the proper legal protection of entrepreneurs’ intellectual property rights, including trademarks, and the promotion of honest market conduct.
