The Senior lawyer of "ELL Partnership" Law Firm Gevorg Virabyan conducted a training course on "Proceedings of confiscation of property of illegal origin"
On May 22 of this year, a training course on "Proceedings of confiscation of property of illegal origin" was held at the RA Bar Academy. The course was conducted by Gevorg Virabyan, assistant professor of YSU state and law theory and history department, Senior lawyer of "ELL Partnership" Law Firm.
Within the framework of the course, such topics were selected that are methodologically oriented in the proper interpretation and application of the legal regulations provided by the RA law "On Confiscation of Property of Illegal Origin".
In particular, the speaker comprehensively presented his vision regarding the nature, type and moment of origin of the legal relationship arising on the basis of the said law, the essence and content of the principles of inadmissibility of arbitrary interference in private affairs and good faith, their role as legal measures regulating that legal relationship.
Particular attention was paid to the question of what methodology the courts should use to compare the formal and substantive elements of the law in case formal-logical (true) and objective gaps appear in the legal practice, trying to interpret, specify, supplement or form some new rule by restricting or adjust an existing rule ex post.
