Legal Victory in Trademark Cancellation Case
We are pleased to announce another significant victory for our team.
Since October 2020, a lawsuit has been pending before the Court of First Instance of General Jurisdiction of Yerevan, seeking the cancellation of trademarks belonging to our client, including a well-known (reputable) trademark. The proceedings in the court of first instance alone lasted over five years. Throughout this period, our client's interests were represented by Gohar Gevorgyan, Shareholder, CEO, and Attorney at "ELL Partnership" Law Firm.
In its judgment, the Court justly affirmed that neither prior to the registration of the trademarks nor during the many years of their subsequent use did our client engage in any actions that could lead to the cancellation of said registrations.
This victory is of paramount importance to our client, as the groundless lawsuit called into question their integrity, product quality, and the impeccable business reputation built over years of operation. We congratulate our client on this principled and significant win.
Furthermore, this case addressed the applicability of Article 21, Part 1, Clause 3 of the RA Law on Trademarks, a matter on which established judicial practice in Armenia was previously lacking. Consequently, this victory holds great significance not only for our client but also for legal professionals involved in the theory and practice of intellectual property law.
